What is Chapter 7 Bankruptcy?

One of the primary purposes of bankruptcy is to discharge certain debts to give an honest individual debtor a "fresh start." The debtor has no liability for discharged debts.

 

In a chapter 7 case, however, a discharge is only available to individual debtors, not to partnerships or corporations. Although an individual chapter 7 case usually results in a discharge of debts, the right to a discharge is not absolute, and some types of debts are not discharged. Moreover, a bankruptcy discharge does not extinguish a lien on property.

What is the Cost?

Chapter 7 Individual Petition Preparation

$350 ($50 Extra if there are over 20 Creditors) 

 

Chapter 7 Joint (married) Petition Preparation 

$400 ($50 Extra if there are over 20 Creditors).

Court Filing Fee $335- You may apply for a waiver of court fees and if approved have all court fees waived, pay a small portion, or have a payment plan of 4 small payments to help break up the cost.

What if I am in a different state?

​

The fee our company charges for a to provide you with Bankruptcy preparation services is $350 for Chapter 7 unless you're one of the states listed below:

 

  • In Wisconsin, the maximum Bankruptcy Petition Preparer is $75.00.

  • In North Carolina, the maximum Bankruptcy Petition Preparer fee is $80. North Carolina and Alabama use Bankruptcy Administrators instead of US Trustees.

  • In Minnesota, the maximum Bankruptcy Petition Preparer fee is $90.

  • In Maryland, Michigan (Eastern District), and New York, the maximum Bankruptcy Petition Preparer fee is $100.

  • In Ohio, the maximum Bankruptcy Petition Preparer fee is $125 (Northern District) and currently up to $200 in Southern District.

  • In California, the maximum Bankruptcy Petition Preparer fee is $125 in Eastern District, $150 in Northern and Southern Districts, and $200 in Central District.

  • In Oklahoma, the maximum Bankruptcy Petition Preparer fee is $150.

  • In Nevada, a Chapter 7 maximum is $150 for first 25 creditors. If there are more than 25 creditors, a Bankruptcy Petition Preparer may charge $100 plus $2 per creditor up to $200. For Chapter 13, a Bankruptcy Petition Preparer may charge $200. A Bankruptcy Petition Preparer must also send the Region 17 Guidelines.
